NOTICE OF INTENT TO ENACT A LEE COUNTY ORDINANCE

Notice is hereby given that the Board of County Commissioners of Lee County, Florida will consider the enactment of a county ordinance in accordance with Article VIII, Section 1, of the Florida Constitution and Chapter 125, Florida Statutes. A description of the proposed county ordinance is as follows:

AN ORDINANCE AMENDING LEE COUNTY LAND DEVELOPMENT CODE CHAPTERS 6 AND 10 AND CERTAIN SECTIONS OF THE FLORIDA BUILDING CODE TO AUTHORIZE THE BOARD OF ADJUSTMENTS AND APPEALS TO HEAR CERTAIN VARIANCE REQUESTS FROM THE FLORIDA BUILDING CODE; LIMIT BUILDING PERMITS BASED ON AFFIDAVIT; AMEND THE DEFINITION OF SUBSTANTIAL IMPROVEMENT; REPEAL AND REPLACE LAND DEVELOPMENT CODE ARTICLE IV FLOOD HAZARD REDUCTION (SECS. 6-401 – 6-476) IN ITS ENTIRETY, TO ADOPT FLOOD HAZARD MAPS, DESIGNATE A FLOODPLAIN ADMINISTRATOR, ADOPT PROCEDURES AND CRITERIA FOR DEVELOPMENT IN FLOOD HAZARD AREAS, AND FOR OTHER PURPOSES; PROVIDE FOR CONFLICTS OF LAW, SEVERABILITY, CODIFICATION AND SCRIVENER=S ERRORS, MODIFICATIONS THAT MAY ARISE FROM CONSIDERATION AT PUBLIC HEARING AND AN EFFECTIVE DATE.

There will be two public hearings held on two separate dates in the County Commissioners Chambers, Lee County Courthouse, 2120 Main Street, Fort Myers, Florida. The first public hearing will be held on Tuesday, the 5th day of May, 2015, at 5:00 p.m., or as soon thereafter as can be heard. The second public hearing will be held on Tuesday, the 19th day of May, 2015, at 9:30 a.m., or as soon thereafter as can be heard.

Copies of this Notice and the proposed ordinance are available for inspection during regular business hours at the Division of Public Resources located in the Courthouse Administration Building, 2115 Second Street, Fort Myers, Florida.

Interested parties may appear at the meeting and be heard with respect to the proposed plan amendment.

A verbatim record of the proceeding will be necessary to appeal a decision made at this hearing. Contact the Lee County Division of Public Resources at 239-533-2737 for further information on obtaining a record.

NOTICE IS HEREBY GIVEN that on Tuesday, the 19th day of May, 2015, at 9:30 a.m., or as soon thereafter as can be heard, in the County Courthouse, 2120 Main Street, Fort Myers, Florida, the Board of County Commissioners of Lee County, Florida, will consider the enactment of a County Resolution pursuant to the State Constitution, Florida Statutes, and Lee County Ordinance No. 98-25. The title of the proposed Resolution is as follows:

A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF LEE COUNTY, FLORIDA, RATIFYING THE COMPLETION OF THE ACQUISITION AND CONSTRUCTION OF ASSESSABLE IMPROVEMENTS CONSTITUTING A PROJECT AS HEREIN DESCRIBED IN AS THE CHERRY ESTATES PARKWAY ROAD IMPROVEMENT CIP MUNICIPAL SERVICES BENEFIT UNIT; CONFIRMING A PRELIMINARY ASSESSMENT ROLL WITH RESPECT TO SUCH UNIT; PROVIDING FOR THE PAYMENT OF SPECIAL ASSESSMENTS AND ESTABLISHING THE NOT TO EXCEED INTEREST RATE SUCH ASSESSMENTS WILL BEAR; DIRECTING LEE COUNTY TO NOTIFY THE PROPERTY OWNERS OF THEIR FINAL ASSESSMENT AND RIGHT TO PREPAY; AND PROVIDING AN EFFECTIVE DATE.

Copies of this Notice and the proposed resolution are available for inspection during regular business hours at the Office of Public Resources located in the County Administration Building, 2115 Second Street, Fort Myers, Florida.

Pursuant to Lee County Ordinance No. 98-25, all objections to the confirmation of the preliminary assessment roll must be made in writing, and filed with the MSTBU Coordinator, as designee of the County Manager, at or before the time of the hearing.

The Board of County Commissioners will meet and receive the objections in writing of interested persons at the public hearing. The special assessments resulting from the confirmation of the preliminary assessment roll will be final and conclusive to each lot/parcel assessed unless steps have been initiated to obtain relief within 20 days in a court of competent jurisdiction.

Interested parties may appear at the meeting and be heard with respect to the proposed resolution.
