PUBLIC NOTICE
PLEASE BE ADVISED that on the 19th day of June, 2012, at 9:30 A.M., or as soon thereafter as may be heard, in the County Commissioner’s Chambers, Lee County Courthouse, 2120 Main Street, Fort Myers, Florida, the Board of County Commissioners of Lee County, Florida will consider and take action on the adoption of a Resolution authorizing the exchange of public property for other real property pursuant to §125.37 of the Florida Statutes.
The public property to be released by Lee County is the County’s interest in an easement used as a public walkway for beach access from Estero Boulevard to the Gulf of Mexico, (at or near the Pink Shell Resort) in Section 24, Township 45 South, Range 23 East, in the Town of Fort Myers Beach, Lee County and State of Florida, legally described as follows:
A six-foot wide public walkway easement lying on Lot 36 of Unit No. 4, Island Shores, and Lot 37 of Island Shores Club Section, recorded in Plat Book 9, Page 37 and Plat Book 9, Page 41, respectively, in the Public Records of Lee County, Florida, more particularly described in the Easement Grant and Covenant to Build and Maintain recorded in Official Records (OR) Book 4393 at Page 474, re-recorded in OR Book 4396 at Page 1005 of said Public Records.
The property interest to be received by Lee County is a replacement easement, also to be used as a public walkway for beach access from Estero Boulevard to the Gulf of Mexico, in the Town of Fort Myers Beach, Lee County and State of Florida, generally described as follows:
A replacement six-foot wide easement located approximately 125 feet westerly and running generally parallel to the easement being released, also in Section 24, Township 45 South, Range 23 East of Lee County, Florida, situate on Lot 38, on the Plat of Island Shore Club Section, as recorded in Plat Book 9, Page 41 of said Public Records.
The terms of the exchange will be the County’s release of property interest in a walkway easement in return for the receipt of a replacement public walkway easement and related improvements. The participating property owners to the exchange will be responsible for all costs of effecting the exchange and the relocation of the beach access walkways, including notice and recording costs, all costs of permitting, construction and subsequent maintenance of the replacement beach access easement. The terms of an Agreement for Exchange of Walkway Easements is requested to be adopted in conjunction with the exchange to further delineate the obligations of the participating property owners in the intended transaction.
Parties to the exchange will be Lee County, JABO, LLC and Captiva Villas Development, LLC. If the Resolution of Exchange is adopted, the closing of said exchange will follow thereafter in accordance with the terms of the Board’s Resolution and the Agreement for Exchange of Walkway Easements.
