Notice is hereby given that the Board of County Commissioners of Lee County, Florida will consider adopting a county ordinance in accordance with Article VIII, Section 1, of the Florida Constitution and Chapter 125, Florida Statutes. The ordinance is:
AN ORDINANCE AMENDING LEE COUNTY LAND DEVELOPMENT CODE, CHAPTERS 2 (ADMINISTRATION) and 14 (ENvironment and natural resources) TO AMEND AND CLARIFY CODE ENFORCEMENT PROCEDURES AND revise wellfield protection provisions regarding the GROUNDWATER MODELING INFORMATION; to PROHIBIT The installation of a water supply well within 2,640 feet of an existing or permitted aquifer storage and recovery well (previously prohibited within 500 feet)
The Specific provisions that are amended are: SEC. 2-421 (CODE ENFORCEMENT POWER AND AUTHORITY OF LEE COUNTY HEARING EXAMINER); SEC. 2-423. (DEFINITIONS); SEC. 2-424. (ENFORCEMENT PROCEDURE); SEC. 2-425. (CONDUCT OF HEARING); SEC. 2-426. (POWERS OF THE CODE ENFORCEMENT HEARING EXAMINER); SEC. 2-427. (PENALTIES AND LIENS); SEC. 2-428. (APPEALS); SEC. 2-429. (NOTICES); SEC. 2-430. (CITATION PROCEDURES; PENALTIES); SEC. 2-431. (CONFLICT); SEC. 14-212. (PROTECTION ZONE MAPS); SEC. 14-216. (CRITERIA FOR ESTABLISHING PROTECTION ZONES); SEC. 14-219. (AQUIFER STORAGE AND RECOVERY WELLS); AND TO amend and replace APPENDIX N (WELLFIELD PROTECTION ZONES)
There will be one public hearing held in the County Commissioners’ Chambers, Lee County Courthouse, 2120 Main Street, Fort Myers, Florida. The public hearing will be held on Tuesday, March 18, 2014 at 9:30 AM, or as soon thereafter as can be heard.
Copies of this Notice and the proposed ordinance are available for inspection during regular business hours at the Division of Public Resources located in the Courthouse Administration Building, 2115 Second Street, Fort Myers, Florida.
Interested parties may appear at the meeting and be heard with respect to the proposed plan amendment.
