PLEASE BE ADVISED that on the 19th day of November, 2019, at 9:30 A.M., or as soon thereafter as may be heard, in the County Commissioner's Chambers, Lee County Courthouse, 2120 Main Street, Fort Myers, Florida, the Board of County Commissioners of Lee County, Florida will consider and take action on the adoption of a Resolution authorizing the exchange of public property for other real property pursuant to §125.37 of the Florida Statutes.
The public property to be released by Lee County is a portion of its interest in the perpetual utility easement located on the real property owned by Fort Myers H Automotive Management, LLC, located at 3550 Colonial Boulevard, Fort Myers, Florida, being its interest in the Perpetual Utility Easement Grant and Indemnity Agreement to Lee County, recorded March 17, 1993, recorded in Official Records (O.R.) Book 2369, Page 2242, ("Utility Easement Grant"), containing 2,097.84± square feet in size, more or less.
The property interest to be received by Lee County is a perpetual utility easement, being 15,772± square feet, ("New Easement") on the real property owned by Fort Myers H Automotive Management, LLC, located at 3550 Colonial Boulevard, Fort Myers, Florida.
The terms of the exchange will be the County's release of property interest in the Perpetual Utility Easement Grant in return for the receipt of the New Easement. The participating property owner to the exchange will be responsible for all costs of effecting the exchange, including notice and recording costs. The terms of an Agreement for Exchange of Easement is requested to be adopted in conjunction with the exchange to further delineate the obligations of the participating property owner in the intended transaction.
Parties to the exchange will be Lee County and Fort Myers H Automotive Management, LLC. If the Resolution Approving Exchange of Property is adopted, the closing of said exchange will follow thereafter in accordance with the terms of the Board's Resolution and the Agreement for Exchange of Easement.
