NOTICE IS HEREBY GIVEN that on Tuesday, the 7th day of February, 2023, at 9:30 a.m., in the County Commissioners' Meeting Room, Old Lee County Courthouse, 2120 Main Street, Fort Myers, Florida, the Board of County Commissioners of Lee County, Florida, will consider the adoption of an Interlocal Agreement with the City of Fort Myers relating to the annexation of the Enclave known as "Marvaez Street" pursuant to Chapters 125, 163 and 171, Florida Statutes, and Chapter 98-488, Laws of Florida, as amended. The title of the proposed Interlocal Agreement is as follows:

INTERLOCAL AGREEMENT BETWEEN LEE COUNTY AND THE CITY OF FORT MYERS PURSUANT TO § 171.046, FLA. STAT., REGARDING THE ANNEXATION OF EIGHT PARCELS CONSISTING OF APPROXIMATELY TWO ACRES LOCATED ALONG MARVAEZ STREET SOUTH OF WINKLER AVENUE IN UNINCORPORATED LEE COUNTY ENCLAVE COMMONLY KNOWN AS "MARVAEZ STREET"; PROVIDING FOR SCOPE; PROVIDING FOR THE TRANSITION OF CERTAIN MUNICIPAL SERVICES; PROVIDING FOR SEVERABILITY, AN EFFECTIVE DATE AND TERMINATION DATE.
 
Copies of this Notice and the proposed Interlocal Agreement are on file in the Minutes Office of the Clerk of Courts of Lee County. The public may inspect or copy the Interlocal Agreement during regular business hours at the Minutes Office. The Minutes Office is located in the Courthouse Administration Building, 2115 Second Street, Fort Myers, Florida.

Interested parties may appear at the meeting in person or through counsel, and be heard with respect to the adoption of the proposed Interlocal Agreement.

Anyone wishing to appeal the decision(s) made by the Board with respect to any matter considered at this meeting, will need a record of the proceedings for such appeal, and may need a verbatim record, to include all testimony and evidence upon which the appeal is to be based.

The Interlocal Agreement shall take effect pursuant to its terms after its adoption and execution by the Board of County Commissioners.
