Notice is hereby given that a PUBLIC MEETING will be held to discuss Land Development Code (LDC) Amendments related to changes in Lee County Height Regulations and Resiliency. The public meeting will be held on WEDNESDAY, the 9TH DAY OF AUGUST, 2023, from 5:30 P.M. TO 7:30 P.M., located at Public Works/DCD Building, Large First Floor Conference Room 1B, 1500 Monroe Street, Fort Myers, FL 33901. A description of the proposed amendments are as follows:

AN ORDINANCE AMENDING THE LEE COUNTY LAND DEVELOPMENT CODE, CHAPTERS 33 (PLANNING COMMUNITY REGULATIONS) AND 34 (ZONING); UNIFORM CALCULATION OF BUILDING HEIGHT; EXCEPTIONS TO HEIGHT LIMITATIONS FOR THE PURPOSE OF RESILIENCY; PERMITTED SETBACK ENCROACHMENTS FOR EXTERIOR STAIRWAYS; PARKING REQUIREMENTS FOR RECONSTRUCTED BUILDINGS; ZONING APPLICATION REQUIREMENTS RELATED TO HOMEOWNERS' ASSOCIATIONS; ISSUES RELATED TO REBUILDING ON CAPTIVA ISLAND AND WITHIN SOUTH SEAS ISLAND RESORT.

THE SPECIFIC LDC PROVISIONS THAT WILL BE DISCUSSED ARE: SEC. 33-1087 (MAXIMUM HEIGHT OF BUILDINGS AND STRUCTURES – GREATER PINE ISLAND); SEC. 33-1611 (APPLICABILITY); SEC. 33-1614 (DEFINITIONS); SEC. 33-1627 (HEIGHT RESTRICTIONS ON CAPTIVA ISLAND); SEC. 34-2 (DEFINITIONS); SEC. 34-201 (APPLICATION REQUIREMENTS FOR PUBLIC HEARING AND ADMINISTRATIVE ACTIONS); SEC. 34-1805 (DENSITY LIMITATION FOR CAPTIVA ISLAND); SEC. 34-2011 (APPLICABILITY OF DIVISION); SEC. 34-2171 (MEASUREMENT); SEC. 34-2172 (EXCEPTIONS TO HEIGHT LIMITATIONS FOR RESILIENCY); SEC. 34-2173 (EXCEPTIONS TO HEIGHT LIMITATIONS FOR CERTAIN STRUCTURAL ELEMENTS); SEC. 34-2174 (ADDITIONAL PERMITTED HEIGHT WHEN INCREASED SETBACKS PROVIDED); SEC. 34-2175 (HEIGHT LIMITATIONS FOR SPECIAL AREAS AND LEE PLAN LAND USE CATEGORIES); SEC. 34-2191 (MEASUREMENT; PERMITTED ENCROACHMENTS); APPENDIX I (PLANNING COMMUNITY AND REDEVELOPMENT OVERLAY DISTRICT BOUNDARIES AND LEGAL DESCRIPTIONS) MAP 18 (SOUTH SEAS ISLAND RESORT).

Copies of this Notice are available for inspection or copying during regular business hours at the Minutes Office of the Clerk of Courts of Lee County, located in the Courthouse Administration Building, 2115 Second Street, Fort Myers, Florida. Interested parties may appear at the meeting in person or through counsel, and be heard with respect to this matter.
