Notice is hereby given that the Board of County Commissioners of Lee County, Florida will consider the enactment of three county ordinances in accordance with Article VIII, Section 1, of the Florida Constitution and Chapter 125, Florida Statutes. The proposed county ordinances will:
ORDINANCE 1 AMENDS LEE COUNTY LAND DEVELOPMENT CODE, CHAPTERS 30, 33, and 34 TO CONSOLIDATE DEVELOPMENT REGULATIONS RELATING TO CAPTIVA INTO CHAPTER 33; revise regulations pertaining to the page park planning community regarding nonconforming screening and buffers; permit Live-work units in all mixed-use districts THROUGH AN administrative approval PROCESS; MODIFY COMMUNITY MEETING REQUIREMENTS; AND, CREATE PROVISIONS FOR DEVELOPMENT STANDARDS; property development rEgulations, sign regulations, and regulations for MULTIPLE-UNIT DWELLINGS AND TOURIST ACCOMMODATIONs within the CAPTIVA PLANNING COMMUNITY.
ORDINANCE 2 AMENDS LEE COUNTY LAND DEVELOPMENT CODE, CHAPTERS 10, 32, and 34 TO PROVIDE for REVISED PARKING REGULATIONS in COMMERCIAL, INDUSTRIAL, AND MIXED USE DEVELOPMENTS; INCLUDING THE MODIFICATION OF PARKING REQUIREMENTS FOR TEMPORARY USES, cLARIFY THE REQUIREMENTS FOR OFF-STREET PARKING FOR LIVE-WORK UNITS, REMOVE REDUNDANT DEFINITIONS AND USE GROUP CATEGORIES, CREATE REVISED DEFINITIONS, INCLUDING DEFINITIONS OF SINGLE-USE AND MULTIPLE-USE DEVELOPMENTS; CREATE A NEW MULTIPLE-USE CATEGORY FOR PARKING CALCULATIONS; PROVIDE AN ADMINISTRATIVE PROCEDURE FOR GRANTING REDUCTIONS IN REQUIRED PARKING; AND, FURTHER TO PROVIDE A MAXIMUM PARKING RATE FOR COMMERCIAL, INDUSTRIAL, AND MIXED-USE PARKING LOTS.
ORDINANCE 3 AMENDS LEE COUNTY LAND DEVELOPMENT CODE, CHAPTERS 30 and 33 TO Clarify the height requirements for Monument signs by specifying that the height of the sign’s base must be at least 24 but no more than 36 inches above the adjacent ground; ProvidE a clear method for measuring sign copy area; Require Community review of Permanent monument-style identification sign permits; ProhibitS Internally illuminated box signs; AND TO remove redundant provisions that were previously consolidated into Chapter 33.
There will be two public hearings held on two separate dates in the County Commissioners Chambers, Lee County Courthouse, 2120 Main Street, Fort Myers, Florida. The first public hearing will be held on Tuesday, the 28th day of August 2012, at 5:05 PM, or as soon thereafter as can be heard. The second public hearing will be held on Tuesday, the 11th day of September, 2012, at 9:30 a.m., or as soon thereafter as can be heard.
Copies of this Notice and the proposed Ordinances are on file in the Minutes Office of the Clerk of the Circuit Court of Lee County. The public may inspect or copy the Ordinances during business hours at the Division of Public Resources. The Minutes Office and the Division of Public Resources are located in the Courthouse Administration Building, 2115 Second Street, Fort Myers, Florida.
Interested parties may appear at the meeting, in person or through a representative, and be heard with respect to the proposed ordinance. Anyone wishing to appeal the decision(s) made by the Board with respect to the matters considered at the meeting will need a record of the proceedings. Generally, a verbatim record, including all testimony and evidence upon which the appeal is to be based, will be necessary.
If adopted by the Board at this meeting, the three ordinances will take effect upon their filing with the Office of the Secretary of the Florida Department of State.
