Please be advised that on the 19 day of April, 2016, at 9:30 A.M., or as soon thereafter as may be heard, in the Commissioners' Meeting Room in the Lee County Courthouse, 2120 Main Street, Fort Myers, Florida, the Lee County Board of County Commissioners will consider and take action on the adoption of a Resolution authorizing the exchange of public real property for other real property pursuant to Florida Statutes §125.37.

The public property interest to be released by Lee County is a portion of a 20-foot wide walkway access easement in Section 23, Township 43 South, Rage 20 East, as described in an easement recorded in the Public Records of Lee County, Florida in Official Records Book 482, Page 377, and being part of Lot 5, Unit No. 1, Golden Beach, as recorded in Plat Book 10, Page 60 of said Public Records; being approximately 2,842 square feet, more or less.

The property interest to be conveyed to Lee County is a new/replacement 20-foot wide public pedestrian beach easement, also in Section 23, Township 43 South, Range 20 East, Lee County, Florida, again being a part of Lot 5, Unit No. 1, Golden Beach, as recorded in Plat Book 10, Page 60 of said Public Records; being approximately 3,098 square feet, more or less.

The terms of the exchange will be the County's release the existing public pedestrian beach access easement in return for the receipt of a new/replacement public pedestrian beach access easement, and appurtenant improvements, at no cost to the County.  The participating property owner will be responsible for all costs necessary to complete the requested exchange, including notice and recording costs. 

Additionally, an Agreement for the Exchange of Real Property is requested to be adopted in conjunction with the exchange to further delineate the obligations of the participating property owner in the intended transaction. 

Parties to the exchange will be Lee County and Boca Grande Beach Club Association, Inc, a Florida non-profit Corporation.  If the Resolution of Exchange is adopted, the closing of said exchange will follow thereafter in accordance with the terms of the Board's Resolution and the Agreement for the Exchange of Real Property.
