notice of intent to enact a lee county ordinance

​Notice is hereby given that the Board of County Commissioners of Lee County, Florida will consider the enactment of a county ordinance in accordance with Article VIII, Section 1, of the Florida Constitution and Chapter 125, Florida Statutes.  A description of the proposed county ordinance is as follows:

AN ORDINANCE OF LEE COUNTY, FLORIDA CREATING THE ALICO ROAD FORCE MAIN EXTENSION REBATEABLE AREA AND ESTABLISHING THE COSTS OF CONSTRUCTION, REPRESENTED BY EQUIVALENT RESIDENTIAL UNITS, REQUIRED TO BE PAID BY PROPERTY OWNERS FOR FUTURE DEVELOPMENT OF PROPERTY WITHIN THE REBATEABLE AREA; PERTAINING TO MODIFICATIONS THAT MAY ARISE FROM CONSIDERATION AT PUBLIC HEARING; PROVIDING FOR ENFORCEMENT, PENALTIES, SEVERABILITY AND AN EFFECTIVE DATE. 

There will be two public hearings held on two separate dates in the County Commissioners' Chambers, Lee County Courthouse, 2120 Main Street, Fort Myers, Florida.   The first public hearing will be held on Tuesday, the 3rd day of May, 2016, at 9:30 a.m., or as soon thereafter as can be heard.  The second public hearing will be held on Tuesday, the 17th day of May, 2016, at 5:00 p.m., or as soon thereafter as can be heard.  

Copies of this Notice and the proposed ordinance are available for inspection at the Minutes Office of the Clerk of Courts of Lee County, located in the Courthouse Administration Building, 2115 Second Street, Fort Myers, Florida.

OBJECTIONS: Objections to this Ordinance on the ground that it contains any default or defect in the passage or character of the Ordinance, the plans or specifications, or estimate; that the Ordinance is void or voidable in whole or in part; that the property identified within the Rebateable Area is not directly benefited by the Project; or that the Ordinance exceeds the power of the Board, or for any other basis shall be made in writing, in person or by attorney, and filed with the Board at or before the time or adjourned time of the Public hearing adopting the Ordinance. Any objections not so made shall be considered as waived, and if an objection shall be made and overruled or shall not be sustained, the adoption of the Ordinance shall be the final adjudication of the issues presented unless proper steps shall be taken in a court of competent jurisdiction to secure relief within 10 days from the date of the public hearing.

Interested parties may appear at the meeting and be heard with respect to the proposed ordinance.
