​NOTICE OF INTENT TO ADOPT A RESOLUTION authorizing the execution of an interlocal property exchange agreement with the City of Fort Myers FOR THE EXCHANGE OF PROPERTY NEAR 5600 LEE BLVD pursuant to Sec. 125.37 of the Florida Statutes

A public meeting will be held on April 5, 2022, at 9:30 a.m. in the Board of County Commissioners Meeting Room, in the Lee County Courthouse, 2120 Main Street, Fort Myers, Florida. At this meeting, the Board of County Commissioners will consider the exchange of public property pursuant to Florida Statutes Sec. 125.37.

Through this exchange, Lee County will deliver a deed to the City of Fort Myers for a strip of unimproved land in the vicinity of 5600 Lee Boulevard, and in exchange Lee County will receive a deed from the City of Fort Myers for a similar size adjoining strip of land containing County road improvements. The exchange is necessitated by a recently-discovered scrivener's error in an Order of Taking dated Dec 9, 1996, which contained an error in the legal description of the land acquired by Lee County.

If the Resolution is adopted by the Board, the closing of said exchange will follow thereafter in accordance with the terms of the Resolution and the Interlocal Property Exchange Agreement between Lee County and the City of Fort Myers.

Copies of this Notice and the proposed Resolution are available for inspection or copying during regular business hours at the Minutes Office of the Clerk of Courts of Lee County, located in the Courthouse Administration Building, 2115 Second Street, Fort Myers, Florida. Interested parties may appear at the meeting of the Board of County Commissioners, in person or through a representative, and be heard by the Board on the proposed Resolution.

Anyone wishing to appeal the Board's decision on matters considered at the meeting will need a recording of the proceedings, Generally, it will be necessary to obtain a verbatim record, including all testimony and evidence upon which the appeal is based.  If the Resolution is adopted by the Board at this meeting, it will take effect immediately.
