A public meeting will be held on January 17, 2023, at 9:30 a.m. in the Board of County Commissioners Meeting Room, in the Lee County Courthouse, 2120 Main Street, Fort Myers, Florida. At this meeting, the Board of County Commissioners will consider the exchange of public property pursuant to Florida Statutes Sec. 125.37.

This is an Amendment to an Exchange Agreement that provided for the exchange of certain real property between the County and Daniels JV; specifically, Daniels JV was to convey to the County approximately 4.84 acres of land referred to in the Exchange Agreement as "Parcels 514/515" to be used by the County for right-of-way for the Three Oaks Parkway Extension North roadway project and the County was to convey to Daniels JV approximately 0.51 acres of land referred to in the Exchange Agreement as the "Fire Station Parcel".

Parties to the exchange will be LEE COUNTY and DANIELS PARKWAY JV DEVELOPMENT, LLC. If the Resolution Authorizing Exchange of Property is adopted, the closing of said exchange will follow thereafter in accordance with the terms of the Board's Resolution and the Real Estate Exchange Agreement.

Copies of this Notice and the proposed Resolution of Exchange are available for inspection or copying during regular business hours at the Minutes Office of the Clerk of Courts of Lee County, located in the Courthouse Administration Building, 2115 Second Street, Fort Myers, Florida. The Minutes Office telephone number is (239) 533-2328.

Interested parties may appear at the meeting of the Board of County Commissioners, in person or through a representative, and be heard by the Board on the proposed Resolution of Exchange.

Anyone wishing to appeal the decision made by the Board on matters considered at the meeting will need a recording of the proceedings. Generally, it will be necessary to obtain a verbatim record, including all testimony and evidence upon which the appeal is based.  If the Resolution of Exchange is adopted by the Board at this meeting, it will take effect immediately.
